Terms and Conditions
By booking with Pod Vision you agree to the following terms and conditions.
​General

Payment and Fees Payment is due at the time of booking to secure your session date and time. All fees are non-refundable, but you may reschedule up to 48 hours before your session date without penalty. If you cancel or reschedule within 48 hours of your session, a new booking fee will be required.

Location: The photoshoot will take place at a mutually agreed upon location. Any additional fees associated with the location (e.g. parking, admission, etc.) will be the responsibility of the client.

Ownership and Copyright The photographer retains the copyright to all images and reserves the right to use them for display, publication, or other purposes. The client has a limited license to use the images for personal use only and may not sell or license the images to any third party.

Image Usage: The client is granted a non-exclusive license to use the images for personal use only. The client may not sell or otherwise use the images for commercial purposes without the express written consent of the photographer. The photographer retains the copyright to all images.

Model Release The client grants the photographer the right to use the images taken during the session for promotional purposes, including but not limited to the photographer's website, blog, and social media accounts. The client also releases the photographer from any claims or liability related to the use of these images.

Liability and Indemnification The client agrees to indemnify and hold harmless the photographer from any claims, damages, or expenses arising from the client's use of the images or from any injuries or damages sustained during the session.

Image Selection and Delivery The photographer will provide a selection of edited images to the client for review and selection within 30 days of the session. The client will receive digital copies of the selected images for personal use. Additional prints, products, and digital files are available for purchase.

Injuries and Damages

The client is responsible for their own safety during the photoshoot. The photographer and/or company will not be held liable for any accidents or injuries that occur during the shoot.

Any damage to the photographer's equipment or studio caused by the client or their guests will be the responsibility of the client. The client will be charged for the cost of any repairs or replacement equipment.

The photographer and/or company is not liable for any lost or stolen personal belongings during the photoshoot.

The client agrees to indemnify and hold harmless the photographer and/or company from any and all claims, damages, expenses, or liabilities arising from or related to the photoshoot.

In the event of unforeseen circumstances such as extreme weather or equipment failure, the photographer and/or company reserves the right to reschedule the photoshoot at no additional cost to the client.

Videography

The Client shall be responsible for obtaining all necessary permissions, permits, and releases required for the Videographer to perform the services described in the Agreement.

The Videographer will provide a finished video product, edited according to the style and format described in the Agreement. The Client shall have the right to request changes to the video up to two (2) times at no additional cost.

The Client understands that the Videographer's creative decisions are final and that the Videographer shall have full creative control over the video production.

The Client understands that video production can be a time-consuming process and agrees to be patient with the Videographer's timeline. The Videographer will strive to provide a finished product within 30 days of the shoot, but this timeline is subject to change.

The Videographer shall have the right to use any footage captured during the production for their portfolio and promotional purposes.

The Client shall indemnify and hold the Videographer harmless against any and all claims, liabilities, damages, costs, and expenses, including reasonable attorney's fees, arising out of or related to the performance of the services under this Agreement.

The Videographer shall not be held responsible for any injuries or damages sustained by the Client or any of their guests during the production. The Client shall be responsible for any damages or injuries caused by themselves or their guests to the Videographer's equipment.

In the event of inclement weather, the Videographer shall work with the Client to reschedule the shoot at a mutually convenient time.

Outdoor Bookings

Weather conditions: In the event of adverse weather conditions, we may need to reschedule the shoot to another day.

Location permits: The client is responsible for securing all necessary permits for the chosen location(s) and ensuring that we have the necessary access to the location(s).

Safety: The client is responsible for ensuring the safety of all persons present at the location(s) during the shoot.

Equipment: We will bring all necessary equipment for the shoot, but we are not responsible for any damage to our equipment caused by the client, location, or weather conditions.

Photography/videography release: The client grants us the right to use the images and/or footage captured during the shoot for promotional purposes, unless otherwise agreed upon in writing.

Cancellation policy: If the client cancels the shoot for any reason, the booking fee will not be refunded. If the shoot needs to be rescheduled due to weather conditions, we will make every effort to find a mutually agreeable date and time.

Liability and indemnification: The client is responsible for any damages or injuries caused to us or our equipment during the shoot. The client agrees to indemnify and hold us harmless from any and all claims, damages, or expenses arising out of the client’s use of the images and/or footage captured during the shoot.

Bookings in the Clients Home

The client is responsible for ensuring that the shooting location is safe and free from any hazards that may pose a risk to the photographer or any equipment used during the shoot.

The photographer reserves the right to refuse to work in any environment that they deem unsafe or unsuitable for the shoot.

The photographer will not be held liable for any damage caused to the client's home or belongings during the shoot.

The client agrees to indemnify and hold the photographer harmless against any claims, damages, or expenses arising from any injuries sustained by the photographer during the shoot.

The photographer reserves the right to reschedule or cancel the shoot in the event of inclement weather, technical issues, or any other circumstances beyond their control.

The client agrees to allow the photographer to use any images or footage captured during the shoot for promotional purposes, unless otherwise agreed upon in writing.
